CONDITIONS AND BENEFITS OF THE PROGRAM

The ICT program is an immigration pathway under the International Mobility Program, allowing eligible foreign business owners to transfer their business to Canada and obtain a work permit. Through the ICT, you can receive an ICT Work Permit and subsequently apply for permanent residency (PR). The spouse and children of the primary applicant are usually granted work and study permits as well.

  • Who can apply for the ICT program?

    2. Senior managers currently working at a foreign company who wish to maintain an equivalent position in Canada.
    3. Key employees with specialized knowledge.

    Individuals in these groups must also meet additional requirements to obtain a work permit under the ICT program.

  • Requirements for the Parent Company

    Successful business owners can apply for the ICT program to expand into Canada, with the following requirements:

    • The parent company must have been operating for at least 12 months (preferably 3 years).
    • The company must have strong financials to support operations in Canada.
    • The applicant must have worked for the company for at least 12 months within the 3 years prior to applying.
    • The parent company must have a relationship with the company in Canada (parent, subsidiary, or affiliate).

    If this is the first time the company is expanding into Canada, a clear business plan is required to ensure the ability to create jobs and effectively manage the business in Canada.

    Company in Canada Requirements:

    • Must have a close relationship with the Vietnamese business, such as a parent company or subsidiary.
    • No minimum investment is required, but investors should have at least $100,000 CAD to operate the business.
    • A business plan outlining the business strategy for opening a branch in Canada.
    • Proof of having purchased or leased a business location in Canada.
    • It is advisable to have at least one employee.

    • Education: At least high school graduation.
    • English proficiency: Minimum CLB 4 at the time of PR application.

    Based on experience, businesses should demonstrate annual revenue of over $250,000 and a minimum of $100,000 to cover expenses for the first year. Additionally, supplemental financial resources are necessary to support the business if it is not self-sustaining after the first year.

    How to Apply for the ICT Work Permit:

    First, you need to ensure that you meet the eligibility criteria for the program. Then, develop a strategy to persuade Canadian immigration authorities and gather evidence to support your application.

    Basic Steps for the Initial ICT Application:

    1. Register the company in Canada as a parent company, subsidiary, or affiliate.
    2. Prepare a business plan that includes projected operations, market research, recruitment plans, and cash flow forecasts for 2-3 years.
    3. Collect the necessary documents (bank statements, proof of investment funds, etc.) and prepare the work permit application.
    4. Submit the application and wait for a decision.

    Note: The process may vary depending on nationality, and visa-exempt citizens may apply at the port of entry (POE).

  • Duration of the ICT Work Permit

    The duration of the ICT Work Permit is typically 1-2 years, with startup companies receiving a permit for only one year. Citizens of some visa-exempt countries may be granted a permit for up to 3 years. The work permit can be extended for an additional 2-3 years, with a maximum of 5 years for skilled employees and 7 years for directors and managers. U.S. citizens and citizens from visa-exempt countries such as Australia, the UK, and EU member states can receive a 3-year work permit due to the Free Trade Agreement with Canada. The program allows for work permit applications without the need for an LMIA, although some cases may still require one.

  • Pathway to Permanent Residency through the ICT Program

    After one year of full-time work at a company in Canada, foreign workers may be eligible to apply for PR through the Express Entry program. Depending on their job role, they may receive an additional 50 or 200 points for a job offer from their employer, significantly boosting their CRS score and increasing their chances of receiving an invitation to apply for PR.

  • Establish a business in Canada.
    In this step, the business will be established and registered in Canada, preparing for operations and expansion here.
  • Submit the application for the Work Permit for the primary applicant, Open Work Permit for the spouse, and Study Permit for the children.
    You will submit the application for the Work Permit for yourself. At the same time, your spouse will receive an Open Work Permit, and your children will obtain Study Permits.

Move to Canada with your family.
  • Approve Work Permit – Move to Canada and operate the business for 12 months.
    Once the Work Permit is approved, you will be able to move to Canada and start operating your business for a period of 12 months.
  • Submit the Permanent Residency (PR) application - Receive PR approval for the entire family.
    After successfully operating your business for 12 months, you can apply for Permanent Residency (PR). Once approved, your entire family will receive PR and have the right to settle permanently in Canada.
