The job offer provides applicants the opportunity to start working legally in Canada with a Canadian employer, which can facilitate the process of obtaining permanent residency later.

Our legal team will guide you and your employer throughout the process, including consulting on the Labour Market Impact Assessment (LMIA) process and its requirements, as well as ensuring the necessary security for the employer to initiate the process.

The LMIA requires employers to demonstrate that they cannot find a suitable candidate locally, thus necessitating the hiring of a foreign worker.

A job offer can lead to a Temporary Work Permit for at least two years, and potentially longer.

 

Pathway to Permanent Residency (PR)

Candidates working for a Canadian employer for over a year may qualify for permanent residency through two different program streams: Express Entry or Canadian Experience Class. Additionally, some employers may also support permanent residency applications through the Provincial Nominee Program (PNP).

  • What is LMIA and why is it important for applying for a job in Canada?

    A Labour Market Impact Assessment (LMIA) is a document that a Canadian employer must obtain in order to hire a foreign worker. The LMIA shows that there are no Canadian citizens or permanent residents suitable for the position, and that hiring a foreign worker will not negatively impact the Canadian labour market. For many types of work visas, an LMIA is required.

  • How do employers apply for an LMIA?

    Employers must apply for an LMIA from Employment and Social Development Canada (ESDC). They must demonstrate that they have made efforts to recruit Canadian citizens or permanent residents but have been unable to find suitable candidates. This process involves posting a job for a specified period of time and providing detailed information about the job, salary, and working conditions.

  • How long does it take to get an LMIA?

    The LMIA processing time can range from 8 weeks to 4 months, depending on the type of job and geographical location. However, positions in high demand or in essential industries may be processed faster under the expedited LMIA processing.

  • How much does it cost to apply for an LMIA and who pays it?

    The current LMIA application fee is CAD 1,000 per job position. According to Canadian government regulations, the employer must pay the entire cost of this fee, and the employee is not allowed to pay any part of this fee.

  • Are Job Offer and LMIA different?

    A Job Offer is a formal offer of employment from a Canadian employer to a foreign worker. An LMIA, on the other hand, is a document that proves that hiring a foreign worker is necessary. In many cases, a worker needs both a Job Offer and an LMIA to apply for a work permit.

  • If I have an LMIA, can I settle permanently in Canada?

    An LMIA only helps you apply for a temporary work permit. However, some immigration programs such as Express Entry can increase your Comprehensive Ranking System (CRS) points if you have a valid Job Offer, making you eligible for Canadian permanent residence. An LMIA can be a stepping stone to permanent residence, but it does not guarantee permanent residence.

  • What types of LMIAs are there?

    There are several types of LMIA depending on the employer’s needs:

    • LMIA for High-Wage Positions: For jobs that offer salaries above the average wage for the province or territory.
    • LMIA for Low-Wage Positions: For jobs that pay below the average wage.
    • LMIA for Caregiver Programs: For positions related to child or elder care.
    • LMIA for Special or Seasonal Jobs: For specific or seasonal employment opportunities.
    • Expedited LMIA under the Global Talent Stream: For high-skilled technical occupations.
  • How long is an LMIA valid for and can it be extended?

    LMIAs are usually valid for 6 to 12 months. After they expire, employers need to reapply for a new LMIA if they want to continue hiring foreign workers. Workers can renew their work permits if they have a new LMIA from their employer.
