Application process Step by Step

1. Sign the franchise agreement.

We highly recommend consulting with a lawyer prior to starting or investing in a business in Canada, as not all business ventures will meet the program's requirements. 2. Develop your business plan

Your business plan is the heart and soul of your application, and immigration officers scrutinize it very carefully to assess your business's viability. Therefore, it is incredibly important that you make sure your business plan has all the necessary information, including your business model, hiring plan, pricing strategy, etc., to convince the officer that your plan is viable and feasible.

3. Begin executing parts of your business plan.

A key aspect of your application is demonstrating the execution of your business vision. Immigration officers evaluate your commitment to operating in Canada and will look for evidence of your progress. Simply opening a bank account and depositing funds may not suffice; additional actions might be required. Your execution plan should align with your business type and strategy.

4. Apply for the C11 work permit.

After gathering sufficient proof of your commitment and evidence of executing your business plan, you can apply for the work permit as a self-employed individual under the C11 LMIA exemption code. Ensure you include all relevant documents, such as proof of your entrepreneurial or managerial experience, financial statements, and support letters from Canadian vendors or customers.

5. Receive approval for your C11 work permit.

The IRCC usually responds within 1-3 months after submit your application and biometrics. If approved, you can begin planning your move to Canada and preparing for a fresh start. However, if it is denied, consult with your lawyer to review the reasons for the refusal. They can help you challenge the decision and consider alternative pathways to achieve your goals.

6. Operate the franchise for 12 months.

If approved, you will get a 2-years work permit (WP) from the CBSA upon arrival in Canada. This one allows you to work exclusively for your own business, not for other employers. Your spouse will typically get an open WP, enabling them to work anywhere in Canada. You must operate your business for at least 12 months to be eligible for permanent residence.

7. Apply for permanent residency (PR).

As a foreign entrepreneur, you can apply for permanent residence under the Express Entry (Federal Skilled Workers) after 12 months of operating your business in Canada with an executive job offer. You must meet the basic eligibility criteria, including having a viable business that supports your senior role and meeting the language skills requirement (CLB 7).
